By using LevyCheck (“the Service”), you agree to these Terms of Service. If you do not agree, please do not use the Service. We may update these terms from time to time, and continued use constitutes acceptance of any changes.

2. Description of Service

LevyCheck is a free benchmarking tool that compares strata levy costs against aggregated data from similar buildings. The Service is provided for informational purposes only and does not constitute financial, legal, or professional advice.

3. No Financial Advice

The benchmarks, health scores, red flags, and recommendations provided by LevyCheck are general in nature and based on statistical comparisons. They should not be relied upon as financial advice. We recommend consulting a qualified strata manager, accountant, or legal professional before making decisions based on your results.

4. Data Accuracy

While we strive to maintain accurate and up-to-date benchmark data, we make no guarantees about the accuracy, completeness, or timeliness of our data. Benchmark data is sourced from:

• Government strata registers
• Public property listings
• Insurance data
• User-submitted levy amounts

Data quality varies by source and location. Results in areas with fewer data points may be less precise.

5. User Submissions

When you submit a levy check, you agree that:

• The information you provide is accurate to the best of your knowledge
• Your submission may be used as an anonymised data point in our benchmark dataset
• You will not submit false or misleading information
• You will not use automated tools to make bulk submissions

6. Feature Waitlists & Communications

Certain features may offer an optional email waitlist. By submitting your email, you agree that:

• We may contact you to notify you when the feature becomes available
• Your email will not be shared with third parties
• You can request removal from the waitlist at any time by contacting us

7. Intellectual Property

The LevyCheck service, including its design, benchmarking methodology, and aggregated datasets, is the intellectual property of Lowen Logic. You may share your individual results but may not systematically extract or reproduce our benchmark data.

8. Limitation of Liability

To the maximum extent permitted by Australian law, LevyCheck and its operators shall not be liable for any loss, damage, or expense arising from your use of the Service, including but not limited to decisions made based on benchmark results, health scores, or recommendations. The Service is provided “as is” without warranties of any kind.

9. Availability

We aim to keep LevyCheck available at all times but do not guarantee uninterrupted access. We may modify, suspend, or discontinue the Service at any time without notice.

10. Governing Law

These terms are governed by the laws of New South Wales, Australia. Any disputes arising from these terms or your use of the Service shall be subject to the jurisdiction of the courts of New South Wales.
